1. Scope of Application (Geltungsbereich)
1.1. These General Terms and Conditions (hereinafter referred to as “Terms” or “AGB”) apply to all contracts concluded between Oleksandr Ganiev (ExImWheels) (hereinafter referred to as “Provider”) and the customer (hereinafter referred to as “Client”) via this website, by email, or by telephone. 1.2. The Provider operates as a service intermediary and consultant (Dienstleister/Vermittler) assisting with vehicle registration, administrative procedures, and technical compliance (TÜV preparation). 1.3. Important Note: The Provider acts solely as a service provider for the registration and administrative handling of vehicles. The Provider does not sell vehicles and does not act as a car dealer. Contracts for the purchase of vehicles are concluded exclusively between the Client and the respective third-party seller.
2. Conclusion of Contract (Vertragsschluss)
2.1. The presentation of services on the website eximwheels.com does not constitute a legally binding offer but a non-binding invitation to the Client to submit a request. 2.2. A contract is concluded when the Client accepts a specific offer sent by the Provider (e.g., via email quote) or when the Provider explicitly confirms the Client’s order in text form (Order Confirmation).
3. Services and Obligations (Leistungen)
3.1. The specific scope of services (e.g., handling registration at the Zulassungsstelle, arranging TÜV inspections, procuring license plates) results from the individual offer or service description. 3.2. Cooperation: The Client is obliged to provide all documents required for the execution of the order (e.g., vehicle title, ID, insurance number eVB) in full and on time. Delays caused by missing or incorrect documents are the responsibility of the Client. 3.3. Third-party Costs: Fees for official authorities (Zulassungsstelle), technical inspection organizations (TÜV/DEKRA), and license plates are generally third-party costs. Unless otherwise agreed (“Package Price”), these are to be reimbursed by the Client.
4. Prices and Payment (Preise und Zahlung)
4.1. The prices stated are final prices. 4.2. Small Business Regulation (Kleinunternehmerregelung): Due to the small business status according to § 19 UStG, no VAT (Umsatzsteuer) is charged or shown on the invoice. 4.3. Payment is due immediately after invoicing unless otherwise agreed. Payment methods are specified in the individual offer.
5. Right of Withdrawal (Widerrufsrecht)
Consumers (Verbraucher) have a statutory right of withdrawal.
Instruction on Withdrawal (Widerrufsbelehrung)
Right of Withdrawal You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of the conclusion of the contract. To exercise your right of withdrawal, you must inform us (Oleksandr Ganiev, ExImWheels, Unterwestrich 18A, 41812 Erkelenz, [email protected], +49 157 57912275) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or an email).
Consequences of Withdrawal If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.
Premature Expiration of the Right of Withdrawal In the case of a contract for the provision of services, the right of withdrawal expires prematurely if we have provided the service in full and have only begun to perform the service after you have given your express consent and at the same time confirmed your knowledge that you will lose your right of withdrawal upon full performance of the contract by us.
6. Liability (Haftung)
6.1. The Provider is liable for intent and gross negligence. 6.2. The Provider assumes no liability for the successful registration of a vehicle if the rejection is based on official decisions, missing documents from the Client, or technical defects of the vehicle that were not known or responsible for by the Provider. 6.3. The Provider is not liable for delays caused by authorities (e.g., slow processing at the Zulassungsstelle).
7. Applicable Law and Jurisdiction (Recht und Gerichtsstand)
7.1. The law of the Federal Republic of Germany applies. 7.2. If the Client is a consumer, this choice of law applies only insofar as the protection granted by mandatory provisions of the law of the country of the consumer’s habitual residence is not withdrawn. 7.3. Place of jurisdiction is the Provider’s seat (Erkelenz), provided the Client is a merchant or acts as a legal entity under public law.
